10/6/2005  Challenge to Ohio “Choose Life” Plate Thrown Out
A federal judge in Ohio has thrown out a challenge aimed at blocking the state’s offering of “Choose Life” license plates. Money raised by the specialty plate typically goes to support crisis pregnancy centers, where pregnant women are presented with alternatives to abortion, including adoption.

9/22/2005  Roberts Deserved Unanimous Committee Approval, But Confirmation Now a "Foregone Conclusion"
Dr. Gary Cass, Executive Director of the Center for Reclaiming America for Christ issued the following statement after today’s 13-5 Senate Judiciary Committee vote to approve the nomination of John G. Roberts, Jr., to be Chief Justice of the U.S. Supreme Court. The Center collected 160,000 petitions in support of Roberts’ nomination which it delivered to Senate Judiciary Committee members last week.

9/14/2005  ACLU Threat Removes 23rd Psalm from Courthouse
The 23rd Psalm display which stood at the Oglethorpe County Courthouse in Lexington, Georgia, has been removed amidst the threat of a lawsuit from the ACLU. The Georgia chapter of America’s so-called protector of all freedoms called the display essentially the same as a Ten Commandments display.

8/24/2005  Abstinence-Only Group's Funding Suspended by Federal Government The Department of Health and Human Services (HHS) has decided to halt funding of the Silver Ring Thing, a group dedicated to abstinence-only education, because of an ACLY lawsuit which alleged that the group's message was an overtly religious one.

8/22/2005  Court Orders Resurrection of Commandments Monument
On August 19, the Eighth U.S. Circuit Court of Appeals ruled in favor of a Nebraska Ten Commandments monument, overturning a lower court decision which had forced the community to remove the decalogue from public property.

8/19/2005  ACLU Defends Woman Guilty of Doing Cocaine While Pregnant
The ACLU has filed an appeal on behalf of an Easton County (Md.) woman who was convicted of reckless endangerment after snorting cocaine while pregnant. The ACLU plans to argue that the unborn child has no rights under the law and is not entitled to any protections.

8/19/2005  Alabama Teachers to Be Given Guide on Religion
As the new school year approaches, the Alabama Education Association (AEA) is set to distribute two booklets on how to handle religion in the state’s public schools to some 50,000 teachers. According to AEA spokesman David Stout, the goal is to dispel the notion that the Bible and prayer are not allowed in public schools.

After members of the Tangipahoa Parish (La.) School Board hosted a conference to discuss religious liberties in the public schools, an ACLU spokesman compared the board members seeking to pray at meetings to "the people who flew the airplanes into the buildings in this country."

7/7/2005  Court Affirms Louisiana Abstinence Program
Louisiana’s abstinence education program has not violated a court-order with its religious content, said U.S. District Court Judge G. Thomas Porteous, Jr. Though the Governor’s Program on Abstinence has religious references on its website, including links to other organizations which promote prayer and abstinence,
there is not an excessive entanglement between government and religion ruled Porteous.

7/7/2005  No Judicial Intervention in Other Commandments Cases
After the Supreme Court issued its conflicting and confusing rulings in the Ten Commandments cases, the same court let stand, without comment, several lower court rulings which outlawed Decalogue exhibits on school grounds and in courtrooms. There are no plans to revisit the cases at this time.

6/28/2005  Gay T-Shirts Allowed by Missouri School District
The ACLU has dropped a lawsuit against a Missouri school district when the district revisited its decision to ban T-shirts containing messages on “gay rights.” The lawsuit stems from a 15-year-old student at Webb City High School who was punished twice for wearing shirts with messages in support of homosexuals.

6/23/2005  West Virginia Court Redefines Family Unit
Though the grandparents were originally awarded custody by the courts, the lesbian partner insisted that she should have custodial rights in this case. Incredibly, on June 17, the West Virginia Supreme Court of Appeals rescinded custody of the 5-year-old boy from the child’s maternal grandparents, declaring that the unrelated lesbian should be deemed the “psychological parent.”

6/14/2005  Ten Commandments Decision Expected Soon
A decision is expected to be handed down soon from the United States Supreme Court on the constitutionality of Ten Commandment displays on public property. When the decision is handed down, it will have been done from a building which features a statue of Moses holding the Decalogue in dispute.

5/19/2005  ACLU Contends Abstinence Education Violates Church and State
The ACLU has filed a lawsuit alleging that an abstinence education program has been the recipient of federal funds in violation of the so-called separation of church and state. Since 2003, the Silver Ring Things, an abstinence education group based in Pennsylvania, has received more than $1 million in federal money earmarked for faith-based initiatives, which President Bush has courageously supported since nearly the inception of his presidency.

5/11/2005  Missouri Says “No Homosexual Adoption”: Lawsuit Filed
The Missouri State Department of Social Services (DSS) adheres to a “no homosexual adoption policy,” which they enforced by telling two Kansas City women that they could not adopt a child. With the aid of the American Civil Liberties Union (ACLU), Lisa Johnston and Dawn Roginski have filed a lawsuit against the state, alleging that such a policy is “unconstitutional.”

5/4/2005  Bible Class OK’d by Texas School Board
A unanimous vote by the school board of Odessa, Texas, has added a Bible class to its high school curriculum. In a show of grassroots support, more than 6,000 residents signed a petition supporting the class, many of whom packed the school board meeting, at which the class was approved.

The American Civil Liberties Union (ACLU) has filed an appeal with Florida’s 4th District Court of Appeals, seeking to overturn an injunction that had been issued to prevent a 13-year-old girl from obtaining an abortion was originally scheduled for April 26.

A bill that prohibits school officials from interfering with student-led and initiated prayer has been passed overwhelmingly by the Arkansas House, 75 to 9. The passage comes despite an ACLU attempt to convince lawmakers that the bill would “likely be unconstitutional” under United States Supreme Court precedent.

3/22/2005  ACLU to Challenge Tennessee Marriage Amendment
The ACLU of Tennessee will reportedly sue to prevent Tennessee from amending its state constitution to define marriage as the union between a man and a woman only. The measure was overwhelmingly supported last week by the Tennessee House, with the intention of putting the issue to voters in November 2006.

The American Civil Liberties Union (ACLU) is urging a federal appeals court to reinstate a lawsuit which challenges the Virginia law used to ban child nudist camps, calling the law unconstitutional. The ACLU argues that the law violates the children’s right to privacy.

2/28/2005  Supreme Court Won’t Hear Alabama Sex Toy Case
The United States Supreme Court has refused to hear a case challenging the constitutionality of an Alabama law which makes it a crime to sell sex toys in the state. A group that regularly uses “sexual devices,” along with two vendors, filed the appeal, saying the case falls in line with a “constitutional right to sexual privacy.”

In November, Florida voters approved a ballot initiative that cleared the way for a parental notification law to be introduced. Florida lawmakers seem ready to propose the law, which would amend the state constitution.

2/22/2005  ACLU Threatens Suit Over “Eyeliner Discrimination”
The ACLU is threatening the E.V. Cain Middle School in Auburn, California, with a lawsuit over the school’s enforcement of a policy to prohibit a boy from wearing eyeliner in school. The ACLU calls it “sexual discrimination.”

2/17/2005  Youth Sexuality Bill Introduced in Congress
A piece of legislation, which seeks to counter abstinence-only sexual education, has been introduced in Congress. The Responsible Education About Life Act would create a $206 million annual grant program to be administered through the Department of Health and Human Services for “comprehensive” sex ed.

2/15/2005  Evolution Stickers an Issue in Kansas, Arkansas
An Arkansas School district has agreed to remove stickers it had placed in science textbooks to warn students that evolution is a theory and not a fact. At the urging of the ACLU, the Beebe School District in Little Rock decided to avoid a threatened lawsuit and consequently allow its students to be taught a theory which is heavily questioned amongst the scientific community.

2/7/2005  Pregnancy Center to be De-funded for Not Offering Abortion
Pro-choice activists in Santa Monica (Calif.) have pointed out that state taxes were being used to fund a crisis pregnancy center which counsels against abortion, and for that reason, a commission which funds “children services” will defund the clinic.

1/31/2005  Virginia High Court Strikes Anti-Fornication Law
On January 14, the Virginia Supreme Court declared the state’s anti-fornication law unconstitutional, citing the U.S. Supreme Court’s 2003 decision in Lawrence v. Texas as the basis for their decision.

1/31/2005  ACLU Omits Religion From Constitution Tutorial
The American Civil Liberties Union (ACLU) — often criticized for infringing on America’s free expression of religion — has been caught red-handed attempting to edit the First Amendment on its own website. Specifically, the organization’s website omitted any mention of religion in its discussion on the First Amendment.

1/31/2005  ACLU Battles City Over Christian Calendar
In Greer, South Carolina, the American Civil Liberties Union (ACLU) has filed an official complaint with city officials, arguing that the Commission of Public Works (CPW) inappropriately published a calendar that includes Bible verses.

1/26/2005  ACLU Targets Louisiana Abstinence Program, Again
The ACLU is claiming that Louisiana is acting in violation of a 2002 court settlement over the administration of a statewide abstinence-education program. Saying that the program “promotes religion,” the ACLU wants the court to hold the state in contempt. In the settlement, the state agreed to tightly monitor spending to ensure that no money would go to “promote religion.”

1/26/2005  Coach Forced to Halt Prayer After ACLU Threatens
A high school wrestling coach in Michigan was ordered to stop leading prayers with team members, after the ACLU threatened to sue the Lincoln Consolidated School District. Though the prayer was not mandated, the entire team participated, quite unlike the ACLU, who has effectively mandated that team members not voluntarily pray. This is a defense of rights?

On January 13, the Florida Supreme Court dismissed a motion filed by the ACLU and Planned Parenthood, which sought to strike down Florida’s Parental Notification Amendment passed on November 2.

1/14/2005  Bible Removed From Houston Courthouse Memorial
On January 10, in compliance with a federal judge’s order, officials removed a Bible from a monument outside the Harris County Courthouse in Houston, Texas. This action came after the 5th U.S. Circuit Court of Appeals lifted its temporary stay, which had allowed the Bible to remain in a memorial display, while the appeals court reviewed the lower court decision.

1/12/2005  Antifacists Omitted From DOJ Rape Treatment Information
Planned Parenthood and the ACLU, among other pro-abortion groups, are lamenting the decision by the Department of Justice (DOJ) to leave antifacists such as the “morning-after pill,” out of its guidelines for treating victims of rape. The pro-abortion groups wanted such drugs included to “spare women an unwanted pregnancy.”

1/11/2005  New Pledge Policy for Virginia School Board
The ACLU of Virginia sent a letter to members of the Spotsylvania (VA) County School Board, urging them to adopt a new policy governing the Pledge of Allegiance. And the school board has complied. Students will not be required to stand during the Pledge of Allegiance.

1/11/2005  Supreme Court Dismisses Fla. Gay Adoption Ban Suit
On January 10, the U.S. Supreme Court dismissed the appeal of four homosexual men seeking to overturn Florida’s ban on adoption by homosexual couples, which remains the only surviving ban of its kind.

1/10/2005  ACLU Halts Pursuit of Restraining Order for Intelligent Design Policy
The ACLU has backed away from a restraining order against the Dover (Penn.) Area School District to prevent the district from enforcing a new policy that allows the teaching of theories of the origins of life other than evolution. The ACLU filed a lawsuit in December 2004, which is still scheduled to go to trial later this year.

1/7/2005  Supreme Court Considers Hearing Florida Homosexual Adoption Ban
The United States Supreme Court is expected to consider what cases will be heard in 2005. Among the list of potential cases is an appeal which seeks to deem Florida’s ban on homosexual adoption unconstitutional.

12/31/2004  Ban on Homosexual Foster Parents Struck Down in Arkansas
An Arkansas state regulation banning the placement of foster children in any household with a homosexual member was struck down by a judge who determined that the state agency enforcing the ban had overstepped its boundaries by trying to enforce “public morality.”

The Washington Supreme Court has ruled that parents no longer have the right to eavesdrop on their children’s phone conversations — establishing a personal right-to-privacy for minors.

The United States Supreme Court has announced that it will hear arguments in two cases involving the Ten Commandments on March 2, 2005. Van Orden v. Perry, a case originating in Texas will be heard first, while McCreary County v. ACLU of Kentucky will be heard shortly thereafter.

On February 18, a three-judge panel of the 8th U.S. Circuit Court of Appeals voted 2-1 to affirm a lower court decision requiring the removal of a 39-year-old Ten Commandments monument from a city park in Plattsmouth, Nebraska. Only weeks after the ruling, the city filed a petition asking for the full body of the appeals court to reconsider the case.
