Birthright Citizenship and Detaining Illegal Aliens10

U.S. immigration law and practice has been a crumbling disaster for decades. President Donald Trump is, in numerous ways, challenging the status quo with policy changes and the ensuing legal battles. He made one change Wednesday and reiterated his desire for another.

First, the latter. “We are looking at birthright citizenship very seriously,” Trump said Wednesday of the practice of conferring U.S. citizenship on children born to illegal aliens on American soil. “It’s frankly ridiculous.” In October 2018, when he first pitched such an executive order11, we discussed at length12 the true meaning of the 14th Amendment. We have long argued it has been grossly misinterpreted to provide for birthright citizenship of the children of illegal aliens — aliens who are not “subject to the jurisdiction” of the U.S. as the amendment clearly states. Its framers absolutely did not intend to confer citizenship on children whose parents flouted U.S. law.

Trump’s intention should he craft such an executive order would clearly be to force the courts to provide greater legal clarity on an issue that has long troubled many Americans. That doesn’t mean Trump would win a legal battle, however. The longstanding practice of conferring that citizenship has convinced many Americans (notably judges) that it’s what the 14th Amendment actually means and that Trump can’t change even the executive branch’s interpretation of it with an executive order.

Second, Trump ordered13 a change regarding detention of families and minors caught illegally crossing the border. In 1997, a court agreement known as the Flores settlement determined how such children should be treated, including releasing unaccompanied minors after only 20 days in custody. In 2015, Judge Dolly Gee, appointed by Barack Obama, expanded that to force the release of even minors who crossed with their parents. (Hello, separating children from parents.)

Political analyst Gary Bauer explains the predictable consequences:

    Not surprisingly, family unit apprehensions have spiked 2,800% over the past six years, a direct result of the [expanded] Flores loophole. (Sadly, there have been thousands of cases of innocent children being exploited by unrelated adults hoping to take advantage of this loophole.)

    President Trump has had enough of this insanity. He is ordering appropriate agencies to detain families together throughout the entirety of their immigration proceedings.

    Under this new rule, no children will be separated from their mothers and no illegal immigrants will be released to disappear into the interior of the country. If they are allowed to remain in the country, they will be released together. If they are ordered deported, they will be deported together.

Over the last five months alone, the Border Patrol has apprehended 137,000 illegal-alien parents and children, only to release them almost immediately. Trump’s order is not just a corrective measure but a deterrent. “They won’t come,” Trump said. “And many people will be saved.”

Au contraire, says House Speaker Nancy Pelosi. Per her usual sanctimonious moralizing, she declared that Trump’s change is “seeking to codify child abuse” and “violating every standard of morality and civilized behavior.” Wrong. He’s merely attempting to reinstate Rule of Law, an utterly foreign concept to today’s Democrats.

Trump Cautions Jewish Voters Who Support Democrats14

Once again the Leftmedia had a conniption fit over President Donald Trump’s latest comments. And once again much of the mainstream media was focused on the question, “How could he say such things?” while seemingly ignoring the deeper question, “Why is Trump saying such things?” It’s no mystery that Trump is a troll, meaning he intentionally drops rhetorical bombs to stir the pot and direct the conversation. This has been his modus operandi going back decades.

Trump on Tuesday asserted that Jewish people who vote Democrat are being “disloyal.” On Wednesday, he further clarified his comments, explaining that he meant they were being “disloyal to Jewish people and very disloyal to Israel.” In other words, Trump’s comments were clearly not the anti-Semitic trope of “dual loyalty” expressed by Democrats Ilhan Omar and Rashida Tlaib. However, it’s easy to see why Trump’s remarks could be taken as offensive, particularly since the vast majority of Jewish Americans vote Democrat and have done so for decades.

Trump’s comments ring similar to those expressed by leftists for years. How many times have Democrats accused women who don’t support their leftist policy positions on women’s issues of voting against their own interests? How many times have black conservatives been told they are working against their own interests? In other words, this is yet another instance of Trump playing politics like a Democrat.

Clearly, Trump is attempting to put a spotlight on the growing and very real problem of anti-Semitism currently metastasizing within the Democrat Party. His calling out of Jewish Americans for supporting Democrats raises a question that has often puzzled many conservatives: Why support a party that is seemingly hell-bent on building a socialist road toward a totalitarian state, especially given the history of how socialist states have treated Jews? And why continue to support a party whose members leading this socialist crusade espouse such anti-Semitic views? Obviously, there’s great nuance involved in the reasons behind anyone’s political opinions, but the question is still valid.

And it is clear that anti-Semitism is a growing problem, specifically in the West. The European Union is poised to enact a rule that eerily harkens back to the Holocaust era. As The Washington Free Beacon reports, “The Advocate General of the European Court of Justice recently issued non-binding opinion arguing that EU law requires Israeli-made products to be labeled as coming from ‘settlements’ and ‘Israeli colonies.’”

While Trump’s methods of political engagement can be grating and off-putting, he is effective in focusing a lot of attention on issues that the MSM might otherwise choose to ignore.

JOB REVISIONS & DEBT: According to Market Watch21, “Turns out hiring wasn’t nearly as strong in 2018 and early 2019 as the government initially reported — by about a half-million jobs. The economy had about 501,000 fewer jobs as of March 2019 than the Bureau of Labor Statistics initially calculated in its survey of business establishments. That’s the largest revision since the waning stages of the Great Recession in 2009. … The average 223,000 monthly increase in employment in 2018 — the strongest in three years — could be trimmed to 180,000 to 185,000, economists estimate.” Additionally, “The Congressional Budget Office has warned that President Trump’s tariffs on China will hurt U.S. GDP and said the comprehensive budget deal the president signed in August will drive up the federal deficit to higher levels than expected,” reports22 National Review. Nevertheless, the Associated Press says23, “A day after considering cutting taxes to promote economic growth, President Donald Trump changed course and said he would abandon the idea because the nation already had ‘a strong economy.’”

GREEN NEW DAYDREAM: Speaking of deficit spending, Reuters reports24: “Presidential hopeful Bernie Sanders unveiled a climate change strategy on Thursday that would mobilize $16.3 trillion to help the U.S. generate 100% of its electricity from renewable energy by 2030 and achieve ‘full decarbonization’ by 2050.” Laughably, the scheme pledges “to create 20 million jobs in the process,” Reuters adds. Sanders claims, “The climate crisis is … the single greatest challenge facing our country.” No — the single greatest challenge is swamp fever.

DANGEROUS PRECEDENT: “A U.S. appeals court in Denver said Electoral College members can vote for the presidential candidate of their choice and aren’t bound by the popular vote in their states. The 10th U.S. Circuit Court of Appeals ruled Tuesday that the Colorado secretary of state violated the Constitution in 2016 when he removed an elector and nullified his vote when the elector refused to cast his ballot for Democrat Hillary Clinton, who won the popular vote. It was not immediately clear what effect the ruling might have on the Electoral College system.” (The Washington Times25)

WHO? NBC News reports26 that “Washington Gov. Jay Inslee is dropping out of the 2020 Democratic presidential race.” Or, as Fox News’s Sean Hannity put it, “Did anybody even know he was in the race?”

STUDENT DEBT CANCELED: According to National Review27, “President Trump on Wednesday signed an executive order directing the Department of Education to cancel all federal student-loan debt for seriously disabled veterans.” Stated Trump, “Veterans … who have made such enormous sacrifices for our country should not be asked to pay anymore. The debt of these disabled veterans will be entirely erased. It will be gone. They can sleep well tonight.”

COUNTERING ANTIFA: Trump this week inveighed, “Antifa, in my opinion, is a terrorist organization.” As such, the president is “considering designating masked Antifa militants as a terrorist organization because of the group’s violent actions across the country,” The Daily Signal reports28, adding: “A designation as a terrorist organization would mean that the federal government would provide federal and local law enforcement with additional resources as needed to deal with Antifa.”
