IN BRIEF

Trump Enforces U.S. Border Laws as Dems Cry Foul11

Thomas Gallatin

U.S. border agents temporarily shut down the San Ysidro border port of entry Sunday and used tear gas to repel a group of several hundred individuals from the Central American migrant caravan who rushed and violently attempted to illegally cross the U.S. border. The caravan, now estimated to be over 8,000 strong, is currently holed up at a sports complex in Tijuana, Mexico, as migrants make their applications for asylum in the U.S.

Following the migrants’ attempted illegal crossing, Homeland Security Secretary Kirstjen Nielsen explained the situation, stating12, “After being prevented from entering the Port of Entry, some of these migrants attempted to breach legacy fence infrastructure along the border and sought to harm CBP personnel by throwing projectiles at them. As I have continually stated, DHS will not tolerate this type of lawlessness and will not hesitate to shut down ports of entry for security and public safety reasons. We will also seek to prosecute to the fullest extent of the law anyone who destroys federal property, endangers our frontline operators, or violates our nation’s sovereignty.”

President Donald Trump then warned he would “permanently13” close the border if more was not done to prevent illegal crossings. “Mexico should move the flag waving Migrants, many of whom are stone cold criminals, back to their countries,” he declared. “Do it by plane, do it by bus, do it anyway you want, but they are NOT coming into the U.S.A. We will close the Border permanently if need be. Congress, fund the WALL!”

Mexico announced that it will be deporting nearly 500 of the migrants. But if Mexico doesn’t want to have to deal with a population of illegal aliens living within its borders, then it too needs to stop them from illegally crossing its own southern border. Indeed, The idea that the U.S. should be responsible for having to house and care for these illegals simply because they mob the border demanding asylum is nonsense. Legally and orderly processing the asylum requests is the only way to properly and effectively handle the issue and prevent abuse. As National Review’s Jim Geraghty astutely observed14, “If you’re trying to run across the border and away from the border patrol, you’re not here to apply for asylum.”

Meanwhile, Democrats and leftists were quick to condemn the Trump administration over the U.S. Border Patrol agents’ use of tear gas to repel the violent illegals, suggesting the response was unnecessary and inhumane. In reality, the actions by U.S. law enforcement in confronting this type of violent and lawless activity is standard procedure for dealing with mobs. In 2013, under the Obama administration, U.S. Border Patrol agents used the same tactics, including tear gas, to repel a similar attempt by migrants to violently rush the border.

On a final note, soon-to-be House Speaker Nancy Pelosi (D-CA) went so far as to call illegal aliens “patriotic15.” That’s an insult not only to American citizens but to immigrants who came here via legal channels. But she’ll do anything to evoke sympathy and woo future Democrat votes.

Roberts Challenges Trump and Gets It Wrong16

Just before Thanksgiving, Chief Justice John Roberts squared off with President Donald Trump in a war of words over the judiciary. After a Barack Obama-appointed judge blocked17 Trump’s order regarding asylum for illegal aliens, Trump griped, “This was an Obama judge.” That’s typical for Trump — and accurate in this case.

But Roberts is a staunch defender of an “independent” judiciary, and he just couldn’t let it pass without comment. In a rare political statement, Roberts declared, “We do not have Obama judges or Trump judges, Bush judges or Clinton judges. What we have is an extraordinary group of dedicated judges doing their level best to do equal right to those appearing before them.”

“I wish Chief Justice Roberts were right,” asserted Rep. Trey Gowdy. “I wish there were not a politicization of the judiciary.”

As much as we too wish Roberts was right as the Founders intended, the modern judiciary is a political animal primarily because Democrat-appointed judges interpret the law not as written but according to a “living Constitution.” Trump was right in his reply: “Sorry Chief Justice John Roberts, but you do indeed have ‘Obama judges,’ and they have a much different point of view than the people who are charged with the safety of our country.”

Perhaps Roberts thinks he’s right because he, an appointee of George W. Bush, cast the deciding vote to find ObamaCare constitutional. But even that illustrates precisely why he’s wrong because Roberts went out of this way to rewrite the law so as to find it “constitutional.” It’s true that Trump’s losses have come at the hands of judges appointed by various presidents, not just Obama, but sometimes those rulings are blocking him from undoing what Obama did — as if Obama’s executive orders were part of the Constitution and Trump’s decision to undo them was thus by definition unconstitutional. A ruling earlier this month on DACA comes to mind18.

On a final note, if Roberts was correct, why did so many conservatives vote for Trump because of the judiciary? Why did Democrats filibuster Neil Gorsuch and then do their “level best” to character assassinate Brett Kavanaugh19? And why won’t a seriously ailing Ruth Bader Ginsburg retire now rather than wait for a Democrat president?

What to Make of the Latest Dire Climate Report20

Nate Jackson

“People are going to die if we don’t start addressing climate change ASAP.” So said socialism’s brightest new star, Alexandria Ocasio-Cortez. But so also said climate scientists Friday in releasing the Fourth National Climate Assessment — the first such report since 2014.

According to21 The Washington Times, “As many as 9,300 more people could die each year because of extreme heat or cold related to climate change by the end of this century. … The range of disease-spreading mosquitoes and ticks will expand, as will extreme weather events — all of which will bring additional mental health problems such as depression and even suicidal tendencies, the U.S. Global Change Research Program, made up of 13 federal agencies, said in the ‘Fourth National Climate Assessment.’”

The Washington Post adds22, “The report finds that the continental United States already is 1.8 degrees Fahrenheit warmer than it was 100 years ago, surrounded by seas that are on average nine inches higher and being racked by far worse heat waves than the nation experienced only 50 years ago.”

The assessment concluded that it’s all man-made: “Both human and natural factors influence Earth’s climate, but the long-term global warming trend observed over the past century can only be explained by the effect that human activities have had on the climate.” And the report came with the requisite warnings that the poor and minorities will be hardest hit.

Specific policy recommendations are not included in the report, though it took a New York second for climate alarmists to renew their calls for draconian regulations to combat the problem. Given the massive expense of such regulation, it struck us that a repeated theme in the new report is how expensive inaction would be. Lost productivity, coastal property damage, and more deaths would indeed be expensive — if predictions are accurate. And the emphasis on human activities as the cause leads to the logical conclusion that human activities must be restricted if we are to slow the trend. We know how expensive that will be, not just in terms of the economy but of Liberty.

Meanwhile, there’s an inconvenient truth: The U.S. is leading the world in reducing carbon emissions23 while President Donald Trump eases regulations, exits the Paris Agreement24, and encourages fossil-fuel development.

Speaking of Trump, he quipped last week, “Brutal and extended cold blast could shatter all records — whatever happened to global warming?” He’s joking, of course, because climate alarmists routinely point to weather events to prove that they’re correct, even while lecturing “deniers” who dare to make those obvious jokes.

Exhibit A: One climate researcher pointing to the deadly California wildfire and saying, “Looking at the smoke, I could not help but think: ‘This is climate change. This is what climate change looks like.’” No, it’s what irresponsible environmental policies look like25. Whether more policies designed by the same extreme leftists can reduce earth’s temperature in the future is the open question, isn’t it?

OPINION IN BRIEF

Marc A. Thiessen: “Trump is right, the U.S. Court of Appeals for the 9th Circuit is a disgrace. This is the court that ruled that the phrase ‘under God’ in the Pledge of Allegiance was unconstitutional, that the Second Amendment doesn’t recognize an individual right to bear concealed arms and that bans on assisted suicide are unconstitutional. This is why it is so important that Trump has nominated, and the Senate has confirmed, a record number of district and circuit court judges — and why liberals are aghast at the pace of Trump’s judicial confirmations. … [Chief Justice John] Roberts is right that our ‘independent judiciary is something we should all be thankful for.’ Rolling around in the rhetorical mud with Trump is not just bad form; it also undermines the very judicial independence Roberts is seeking to uphold.”

SHORT CUTS

The Gipper: “I urge you to beware the temptation … to ignore the facts of history and the aggressive impulses of any evil empire, to simply call the arms race a giant misunderstanding and thereby remove yourself from the struggle between right and wrong, good and evil.”

For the record: “I think the [special counsel] report is going to be devastating to the president and I know that the president’s team is already working on a response to the report. … I still don’t think it’s going to make a criminal case, because collusion is not criminal.” —Harvard Law Professor Alan Dershowitz

Non Compos Mentis: “That’s not the law. They should be allowed to come in [and] seek asylum. That’s the law.” —Rep. Elijah Cummings rejecting Trump’s plan to make caravan migrants wait in Mexico

Non sequitur: “Asking to be considered a refugee & applying for status isn’t a crime. It wasn’t for Jewish families fleeing Germany. It wasn’t for targeted families fleeing Rwanda. It wasn’t for communities fleeing war-torn Syria. And it isn’t for those fleeing violence in Central America.” —Congresswoman-elect Alexandria Ocasio-Cortez

Hot air: “People are going to die if we don’t start addressing climate change ASAP. It’s not enough to think it’s ‘important.’ We must make it urgent. That’s why we need a Select Committee on a Green New Deal, & why fossil fuel-funded officials shouldn’t be writing climate change policy.” —Alexandria Ocasio-Cortez

The BIG Lie: “We do not have Obama judges or Trump judges, Bush judges or Clinton judges.” —Supreme Court Chief Justice John Roberts

And last… “I wish Chief Justice Roberts were right. I wish there were not a politicization of the judiciary. But it’s not just politicians. … It’s been happening for 50 years that we have used political terms to describe judges.” —Rep. Trey Gowdy (R-SC)
