Supreme Court: Motorists Fleeing Cops Can't Sue

The Supreme Court ruled Monday that motorists fleeing police do not have the right to sue pursuing officers if they are injured during the chase.

The 8-1 ruling was handed down in the case of a Georgia teenager who was left paralyzed after police ran his car off the road.

The justices ruled that 19-year-old Victor Harris could not sue former Coweta County sheriff's deputy Timothy Scott for injuries Harris sustained during the March 2001 high-speed chase.

During its review of the case, the justices viewed video showing Harris in a black Cadillac being rammed by Scott. After the ruling the video was posted on the high court's website.

Writing for the majority, Justice Antonin Scalia wrote that police officers are not required to end pursuit of a fleeing motorist if the officers reasonably expect that other people could be hurt. Officers may take measures to stop a fleeing car without risk of facing lawsuits claiming a violation of constitutional rights, Scalia said.

''A police officer's attempt to terminate a dangerous high-speed car chase that threatens the lives of innocent bystanders does not violate the Fourth Amendment, even when it places the fleeing motorist at risk of serious injury or death,'' Scalia said.

Justice John Paul Stevens dissented.

The Supreme Court's ruling reverses findings by lower federal courts allowing Harris to sue.

I find a couple of things disturbing in this....

1) that it even had to make it to the SC...let alone any court
2) that it was 8 to 1

What I find even more disturbing is the fact that an illegal alien drug smuggler can sue.
